Lesbian, gay, bisexual, and transgender (LGBT) persons in Saint Helena, Ascension and Tristan da Cunha may face legal challenges not experienced by non-LGBT residents. Both male and female same-sex sexual activity is legal in Saint Helena, Ascension and Tristan da Cunha, but it is not clear if same-sex couples and households headed by same-sex couples are eligible for the same legal protections available to opposite-sex couples.

The St Helena, Ascension and Tristan da Cunha Constitution Order 2009 bans discrimination based on sexual orientation.

Recognition of same-sex relationships

Legal status of same-sex unions is diverse within the territory. Same-sex marriage is legal in Ascension Island since 1 January 2017 and would soon be legal on Tristan da Cunha, as the Tristan da Cunha Island Council (during a meeting on 23 February 2017) has agreed with the Governor of Saint Helena that a law to legalise same-sex marriage will go forward formally for adoption. Saint Helena does not currently recognise same-sex unions.
