Austin v. United States, 382 F.2d 129 (D.c. Cir. 1967) is a United States case “holding that federal appellate court has power... to modify conviction by reducing it to a lesser included offense”. It reviewed the history of the premeditation rule set forth in United States v. Watson (1985).
